Virtual Office Website (VOW) Terms of Use
These Terms and Conditions govern access to MLS® Listing Information made available through this password-protected Virtual Office Website operated by Kristina Bradley, Sales Representative, CENTURY 21 FIRST CANADIAN CORP., Brokerage. By creating or reconfirming a VOW account, you agree to these terms.
1. Broker-consumer relationship and permitted purpose
You acknowledge a lawful broker-consumer relationship with the VOW operator for the purpose of receiving residential real estate brokerage services through this VOW. You confirm that you have a bona fide interest in the purchase, sale, or lease of real estate of the type offered through the VOW. Registration alone does not create a representation agreement or financial obligation; any representation agreement must be entered into separately where applicable.
2. Personal, non-commercial use
MLS® Listing Information is provided only for your personal, non-commercial use in connection with your bona fide consideration of real estate. You may not use VOW data for advertising, solicitation, resale, commercial databases, lead lists, competitive products, or any unrelated purpose.
3. No redistribution, copying or automated collection
You must not distribute, redistribute, publish, republish, transmit, export, sell, sublicense, reproduce, copy, scrape, data mine, database scrape, screen scrape, download in bulk, reorganize, profile, extract patterns from, or otherwise exploit MLS® Listing Information. You must not use robots, spiders, automated tools, AI systems, software or manual processes to systematically collect or monitor VOW data.
4. Account security
Your VOW credentials are personal to you and must not be shared. You are responsible for maintaining the confidentiality of your credentials and for activity through your account. Access may be suspended or terminated where misuse, unauthorized access, scraping or another security concern is detected.
5. Listing information and intellectual property
MLS® data, Listing Information, the MLS® database and related proprietary materials remain the intellectual property of PropTx, TRREB, participating Member Associations and/or their licensors as applicable. Nothing in these Terms transfers ownership or grants rights beyond the limited VOW access permitted for your real estate search.
6. Accuracy and availability
Information is deemed reliable but is not guaranteed accurate by PropTx Innovations Inc. Listing information can change, may be delayed, and may occasionally be unavailable. You should independently verify information that is important to a purchase, sale or lease decision.
7. Listing brokerage and VOW operator
The listing Brokerage is identified with each MLS® listing. Where a property is listed by another Brokerage, the contact information and services of the VOW operator are presented separately from the listing Brokerage information.
8. Monitoring, audit and compliance access
You acknowledge that PropTx, TRREB, participating VOW Members and their duly authorized representatives may monitor or access the VOW as permitted for security, audit, enforcement and verification of compliance with applicable MLS® rules, policies and VOW requirements. The VOW operator maintains an audit trail of protected VOW activity for security and compliance purposes.
9. Privacy
Personal information collected through registration and VOW use is handled in accordance with the VOW Privacy Policy and applicable privacy law. Information may be disclosed where permitted or required for VOW auditing, security, compliance, enforcement or legal purposes.
10. Access limits and security controls
The VOW may limit the number of listings returned in response to an inquiry, rate-limit activity, require renewed authentication or acceptance of updated terms, and apply other reasonable security controls intended to prevent scraping, data mining and unauthorized access.
11. Suspension or termination
The VOW operator may suspend or terminate access for breach of these Terms, misuse of MLS® information, account sharing, suspected automated collection, security concerns, loss of eligibility for VOW access, or where required by PropTx, TRREB, the Brokerage, applicable MLS® rules or law.
12. Changes
These Terms may be updated to reflect changes to MLS® rules, VOW requirements, law, security practices or website functionality. Where the Terms materially change, continued protected VOW access may require acceptance of the current version.
Bona fide use notice: The information provided herein must only be used by consumers that have a bona fide interest in the purchase, sale, or lease of real estate and may not be used for any commercial purpose or any other purpose.
Reliability notice: Information is deemed reliable but is not guaranteed accurate by PropTx Innovations Inc.
